Wrongful Convictions Vacated

People v. Danny Sarita, Indictment No. 5942/08.  New York County

Danny Sarita was arrested on November 10, 2007, after he surrendered to detectives at the 34th Police Precinct, and was charged with slashing another person in the face during a melee outside the Melodia nightclub in Washington Heights earlier that day. He was ultimately indicted for that conduct and charged with the crimes of Assault in the First and Second Degrees and Gang Assault in the Second Degree.

He was convicted of the crime of Gang Assault in the Second Degree and sentenced to a term of Four (4) years incarceration.

Based on the investigation by Smith Law & Investigations and the legal representation provided by Peter Smith, on March 16, 2012, Sarita’s conviction and sentence were vacated on consent and he was ordered freed immediately by the Honorable Thomas Farber, Supreme Court, New York County.

Acquittals/Dismissals

People v. Kevin Dunne  2011 Suffolk County Dockets 2010SU009781; 2010SU044953, 2010SU047934.

Dunn was arrested by Suffolk County Police and charged with Driving While Intoxicated as a Felony after he was allegedly seen running from a vehicle at the scene of an auto accident with injuries.

Dunn was identified in a lineup by witnesses and placed under arrest.  He was unable to make bail.

Based on the investigation by Smith Law & Investigations and the legal representation provided by Peter Smith, Smith was able to prove that Dunn was not the operator and all charges were dismissed on February 28, 2011.
